These Terms of Service form a binding agreement between you and Tayeb Inc., a company registered in the Hashemite Kingdom of Jordan, and govern your access to and use of the Tayeb websites, the Tayeb customer app, Tayeb Driver, Tayeb Merchant, Tayeb POS, and any related services (together, the "Tayeb Services"). By creating an account, placing an order, accepting deliveries, or otherwise using the Tayeb Services, you agree to these Terms. Please read them carefully.
1. About Tayeb
Tayeb operates a technology platform that connects customers with independent restaurants, grocery stores and other merchants, and arranges for delivery by independent drivers. Tayeb is not a restaurant, a grocery store, or a transport company. When you order through Tayeb, the contract for the food, drinks or goods you buy is between you and the merchant that prepared them.
2. Eligibility and accounts
To use Tayeb you must be at least eighteen years old or the legal age of majority in your country of residence. You are responsible for the accuracy of the information you provide, for keeping your password confidential, and for all activity that takes place under your account. You may close your account at any time from inside the app.
3. The Tayeb apps
The Tayeb customer app is intended for ordering. Tayeb Merchant is intended for restaurants and merchants accepting orders. Tayeb Driver is intended for drivers carrying out deliveries. Tayeb POS is intended for merchant in-store operations. Each app has additional in-app terms that apply alongside these Terms. In case of conflict between in-app terms and these Terms, the in-app terms control for the specific subject they cover.
4. Placing an order
When you place an order, you make an offer to buy from the merchant on the conditions shown in the app, including the listed price, any applicable taxes, the service fee, and the delivery fee. The merchant decides whether to accept your order. Once the order is accepted, the contract for the goods is formed between you and the merchant, and Tayeb arranges the delivery on your behalf.
5. Pricing, fees and taxes
Prices for menu items are set by the merchant. Tayeb may add a service fee, a delivery fee, and a small order fee where applicable. All applicable taxes are included or added at checkout in line with Jordanian law. The total amount payable is always shown to you before you confirm the order.
6. Payments
You can pay by cash on delivery or by accepted debit and credit cards in the cities where these options are supported. Card payments are processed by licensed payment service providers, and Tayeb does not store full card numbers on its servers. If a payment fails, your order may be cancelled.
7. Delivery
Estimated delivery times shown in the app are estimates, not guarantees. Delivery may take longer due to traffic, weather, road closures, restaurant preparation times or other factors outside Tayeb's control. You are responsible for providing an accurate delivery address and for being available to receive the order at the address you provided.
8. Cancellations and refunds
You may cancel an order before the merchant accepts it at no cost. Once the merchant has accepted the order, cancellation may not be possible or may be subject to a charge that covers the food already prepared and the driver's time. If your order arrives incorrect, missing items, or in unacceptable condition, contact us through the in-app help within twenty four hours and we will investigate. Refunds, where due, are issued to the original payment method.
9. Promotions and credit
From time to time Tayeb may offer discounts, promo codes, vouchers or Tayeb credit. These are subject to additional terms shown when the promotion is offered. Promotions cannot be combined unless explicitly stated, cannot be exchanged for cash, and may be withdrawn at any time where allowed by law.
10. Your conduct
When using Tayeb you must not break the law, infringe anyone's rights, harass restaurant staff or drivers, attempt to gain unauthorised access to the Tayeb Services, scrape data from the apps, use Tayeb to send spam, or use the Tayeb Services in any way that could damage them or other users. We may suspend or terminate accounts that breach these rules.
11. Merchant terms
If you are a restaurant or merchant accepting orders through Tayeb Merchant or Tayeb POS, a separate merchant agreement applies in addition to these Terms. That agreement covers menus, commissions, payouts, food safety, accurate descriptions, taxes and other operational matters.
12. Driver terms
If you deliver orders using Tayeb Driver, a separate driver agreement applies in addition to these Terms. Drivers are independent contractors, not employees of Tayeb. The driver agreement covers documents required to deliver, payment for completed deliveries, vehicle requirements and conduct expected on the road.
13. Intellectual property
Tayeb, the Tayeb logo, the Tayeb word mark, the four app icons and the contents of the Tayeb Services are owned by Tayeb Inc. or its licensors and are protected by applicable laws. You may not copy, modify, distribute, reverse engineer or create derivative works from the Tayeb Services without our prior written consent, except as permitted by law.
14. Third party content
Menus, photos and descriptions of restaurants are provided by the restaurants themselves and are their responsibility. Tayeb does not guarantee that this information is always complete or up to date and is not liable for menu errors or allergen information published by third parties.
15. Disclaimer
The Tayeb Services are provided on an "as is" and "as available" basis. While we work hard to keep the Tayeb Services reliable, accurate and secure, we do not warrant that they will always be uninterrupted, error free or meet your specific expectations. Tayeb does not warrant the quality, safety or fitness of food prepared by independent merchants.
16. Limitation of liability
To the maximum extent permitted by Jordanian law, Tayeb's total liability to you for any claim arising from the use of the Tayeb Services is limited to the amount you paid Tayeb for the order that gave rise to the claim. Tayeb is not liable for indirect or consequential losses, including loss of profit, loss of business, or loss of opportunity. Nothing in these Terms excludes liability that cannot be excluded by law.
17. Suspension and termination
We may suspend, restrict or terminate your access to the Tayeb Services at any time if we reasonably believe you have breached these Terms, used the Tayeb Services fraudulently, or put other users, drivers or merchants at risk. Where possible we will give you notice and an opportunity to fix the issue before we take action.
18. Changes to these Terms
Tayeb may update these Terms from time to time. When we do, we will post the updated version inside the Tayeb apps and on this page and update the "Last updated" date. Material changes will be highlighted to you the next time you open the app. Your continued use of the Tayeb Services after the changes take effect means you accept the updated Terms.
19. Governing law and disputes
These Terms are governed by the laws of the Hashemite Kingdom of Jordan. Any dispute that cannot be resolved through our support team will be referred to the competent courts of Amman, Jordan. Nothing in these Terms restricts any rights you have under mandatory consumer protection laws of Jordan.
